Terms and conditions

1. Acceptance of these terms

These terms and conditions form a legally binding agreement between you and Podify ("Podify", "we", "us" or "our"). By creating an account, starting a trial or otherwise using the service, you confirm that you accept these terms and agree to comply with them. If you do not agree, please do not use Podify.

2. Eligibility

To use Podify and to take out a subscription you must:

• be at least 18 years old;
• be the holder of the payment card used, or have the express permission of the cardholder to use it; and
• provide accurate registration and payment information.

By subscribing you confirm that you meet these requirements.

3. The service

Podify is a subscription streaming service that provides access to over 2 million podcasts and more than 40,000 live radio stations, ad-free, with offline downloads and playback on any supported device. We work to keep the service available and to improve it, but the specific content available may change over time as titles and stations are added or removed. We do not guarantee that any particular podcast or station will always be available.

4. Your account and security

You are responsible for keeping your account details, including your login credentials, confidential, and for all activity that takes place under your account. Your account is for your personal use. Please tell us promptly at contact@podify-uk.com if you believe your account has been used without your permission. We may suspend or close accounts that breach these terms.

5. Subscription and payment terms

Podify is a paid subscription billed to your payment card through a third-party PCI-DSS-compliant payment processor. By starting your subscription you authorise us and our payment processor to charge your card as set out below.

• Trial: your trial costs £1.95.
• Recurring subscription: after the trial period, unless you cancel, you will be charged £19.95 per month on a recurring basis until you cancel.
• Automatic renewal: your subscription renews automatically each month and the monthly fee is taken from your card on each renewal date until you cancel.
• Card details: you must provide valid, up-to-date card details and keep them current. If a payment fails, we may retry it or suspend access until payment is made.
• Price changes: we may change the subscription price from time to time. We will give you reasonable advance notice of any change, and it will take effect at your next renewal. If you do not wish to accept a price change, you can cancel before it takes effect.

All prices are in pounds sterling and include any applicable taxes unless stated otherwise.

6. Cancellation and your right to cancel

Cancel at any time. You can cancel your trial or subscription at any time through your account settings or by emailing contact@podify-uk.com. If you cancel during the trial, you will not be charged the monthly fee. If you cancel a paid subscription, your cancellation takes effect at the end of the current billing period and you will not be charged again after that.

14-day cancellation right. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you normally have the right to cancel a distance contract within 14 days without giving a reason. Because Podify is digital content and a streaming service that is made available to you immediately, you agree that we may begin providing the service during the cancellation period. Where you have expressly requested this and acknowledged that you will lose your right to cancel once the service has begun and been fully performed, your statutory right to cancel may not apply in the usual way. This does not affect your other legal rights, and you can still cancel your subscription at any time as described above.

Refunds. Except where required by law, we do not provide refunds for partial months or for periods during which you retained access to the service. Nothing in these terms affects your statutory rights.

7. Acceptable use

You agree to use Podify lawfully and only for your personal, non-commercial enjoyment. You must not:

• copy, record, download (other than through the offline feature for personal use), redistribute, broadcast or publicly perform any content;
• share your account or login details with others, or let others use your subscription;
• circumvent, disable or interfere with any security, access-control or technical measures;
• use automated tools to access or scrape the service; or
• use the service in any way that is unlawful, infringes the rights of others or could damage or disrupt the service.

8. Intellectual property

The podcasts, radio streams, station names, titles, artwork and other content available through Podify are owned by their respective owners and are protected by intellectual property laws. The Podify name, software, design and branding are owned by us or our licensors. We grant you a limited, personal, non-transferable and non-exclusive licence to access and listen to the content for your own personal, non-commercial use for as long as your subscription is active. No other rights are granted.

9. Disclaimers and liability

We provide the service with reasonable care and skill. However, the service is provided on an "as available" basis and we do not guarantee that it will always be uninterrupted, error-free or that every title or station will be available at all times.

Nothing in these terms limits or excludes our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence or for fraud. Subject to that, we are not liable for losses that are not reasonably foreseeable, or for losses arising from your own breach of these terms or misuse of the service. Your statutory rights as a consumer are not affected.

10. Changes to these terms

We may update these terms from time to time, for example to reflect changes to the service or to legal requirements. When we make material changes, we will update the date at the top of this page and, where appropriate, notify you. Your continued use of Podify after changes take effect means you accept the updated terms.

11. Governing law

These terms and any dispute arising out of or in connection with them are governed by the laws of England and Wales, and the courts of England and Wales will have jurisdiction, subject to any mandatory consumer protection rules that apply where you live in the United Kingdom.
